FCC Sets Aside Monal Demolition Order, Sends Ownership Dispute Back to Trial Courts

The Federal Constitutional Court has set aside the earlier directions that had paved the way for demolition of Monal Restaurant and related structures in the Margalla Hills National Park. The court allowed review appeals filed by the Capital Development Authority and the Metropolitan Corporation and restored the underlying ownership and lease disputes to the relevant trial courts for independent and early decisions.

The ruling does not automatically reopen Monal Restaurant or finally determine ownership rights. Instead, it separates the civil ownership dispute from administrative and environmental regulation, directing that each matter be handled by the competent forum. The FCC had earlier questioned whether demolition directions were issued while civil proceedings and related appeals were still pending. The court stressed that its decision was based on legal principles and jurisdiction rather than any agreement between the parties.
