FCC Shifts Illegal Construction Responsibility to Sindh Authorities

A recent Federal Constitutional Court ruling has placed responsibility for preventing and regulating illegal construction on the Sindh government and the Sindh Building Control Authority (SBCA). According to the reported legal analysis, senior lawyers and constitutional experts observed that broad demolition directions in previous proceedings had raised questions regarding the limits of judicial jurisdiction. The latest decision is expected to clarify the role of provincial authorities in enforcing building regulations, controlling unauthorised development and protecting public amenities. Sindh’s relevant departments and the SBCA will now face greater responsibility for ensuring that construction activity complies with applicable laws and approved land-use regulations. The ruling may also influence the handling of residential plots, commercial activities and unauthorised structures in Karachi and other parts of Sindh. Effective regulatory enforcement and transparent development control will be critical in determining the practical impact of the decision.
